These Terms govern your use of the YAAP conversational commerce service ("Service") delivered over WhatsApp. By sending a message to a business that operates on YAAP, you accept these Terms.
1. The Service
YAAP provides software that lets businesses ("Merchants") receive WhatsApp messages from buyers ("you") and reply through an AI-powered assistant. YAAP is a technology provider, not the seller. Each Merchant is solely responsible for the products, prices, fulfillment, and customer-service obligations associated with orders placed through their WhatsApp number.
2. Eligibility
You must be of legal age to enter into a contract in your country and capable of complying with these Terms. If you use the Service on behalf of a third party, you represent that you have authority to bind them.
3. Acceptable use
- Do not send abusive, harassing, threatening, or unlawful content.
- Do not use the Service to attempt to gain unauthorized access to accounts, systems, or data.
- Do not send spam or automate messages without prior authorization from the Merchant.
- Do not impersonate any person or misrepresent your identity.
- Do not transmit malware, exploits, or test payloads against the Service.
4. Orders, payments, and shipping
When you place an order through a Merchant on YAAP, the sales contract is between you and the Merchant. Payment is processed by the Merchant's payment partner (e.g. Wompi or Stripe). Shipping is fulfilled by the Merchant or their logistics partner. Refund and return policies are set by the Merchant; raise disputes with the Merchant first, and contact the relevant payment partner or consumer-protection authority if unresolved.
5. AI-generated content
Replies you receive are generated in part by AI models. While we work to keep them accurate, the responses may contain mistakes. Always confirm prices, availability, and order details before paying.
6. Intellectual property
YAAP, the Merchant, and our licensors retain all rights in our respective software, branding, and content. You receive only the limited right to use the Service for personal, non-commercial shopping purposes.
7. Privacy
Your data is processed as described in our Privacy Policy. Read it before using the Service.
8. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, YAAP disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the maximum extent permitted by law, YAAP is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue arising from your use of the Service. Our aggregate liability will not exceed the fees, if any, you paid to YAAP (not to a Merchant) in the 12 months before the claim.
10. Suspension and termination
We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms or applicable law, or to protect the integrity of the Service.
11. Governing law
These Terms are governed by the laws of the Republic of Colombia for buyers in Colombia, and by the laws of the United Mexican States for buyers in Mexico. Disputes will be resolved by the competent courts of Bogotá, Colombia unless mandatory consumer-protection rules require another forum.
12. Changes
We may update these Terms. The new version takes effect when posted at this URL. Continued use of the Service after that date is acceptance of the new Terms.
